Terms and Conditions of Sale

These Terms and Conditions apply to all sales of goods supplied by Stone & Outdoor Pty Ltd (ABN 61 113 250 972).
By placing an order with Stone & Outdoor Pty Ltd (“Stone & Outdoor”, “we”, “our”, or “us”), you agree to these Terms and Conditions.

2. Definitions
Goods means any products supplied by Stone & Outdoor including but not limited to natural stone, pavers, tiles, cladding, and related products.
Customer means the person, business, or entity purchasing goods from Stone & Outdoor.
Order means any request for goods submitted via website, email, phone, purchase order, or in person.
Quote means a written or electronic quotation provided by Stone & Outdoor.
3. Orders and Acceptance
Orders may be placed through:

Phone
In person
Written purchase order
An order is deemed accepted when:
Stone & Outdoor issues an invoice or order confirmation, or
payment is received.
Stone & Outdoor reserves the right to accept or decline any order.
Website orders may require customers to be logged in. Non-logged-in users may be required to submit a request for quotation.
4. Pricing
Unless otherwise stated:
All prices are exclusive of GST
Delivery charges are additional
Quotes remain valid for 30 days unless otherwise stated in writing.
Stone & Outdoor reserves the right to amend pricing prior to order acceptance.
5. Payment Terms
Standard Orders
Payment must be made in full at least 48 hours prior to delivery or collection, unless a credit account has been approved.
Custom or Special Orders
Custom or special-order products may require:
50% non-refundable deposit
The remaining balance must be paid prior to dispatch or collection unless otherwise agreed.
Trade Credit Accounts
Approved trade customers may apply for 14 day or 30 day end-of-month (EOM) accounts, subject to credit approval.
Stone & Outdoor reserves the right to suspend or withdraw credit facilities at any time.
Late Payments
Stone & Outdoor reserves the right to charge:
interest on overdue accounts
recovery costs including legal fees and debt collection costs.
6. Samples
Stone & Outdoor may provide up to three (3) free samples.
Shipping charges for samples are calculated automatically through the website cart.
Samples are provided for indicative purposes only and may not represent the exact batch or appearance of the final product supplied.
Samples are non-refundable.
7. Delivery
Stone & Outdoor may arrange delivery using third-party freight carriers.
Most deliveries are made via pallet freight.
Delivery is generally to the kerbside or nearest accessible point.
Placement beyond this point may occur only if considered safe and practical by the driver.
Customers must ensure:
adequate access for delivery vehicles
safe unloading conditions
suitable equipment if required.
Stone & Outdoor will make reasonable efforts to meet delivery timeframes but cannot guarantee delivery times.
Stone & Outdoor is not responsible for delays caused by:
freight carriers
traffic
weather
port congestion
supplier delays
events outside our control.
8. Delivery Equipment and Site Responsibility
Where Stone & Outdoor assists with unloading goods using equipment such as:
crane trucks
forklifts
pallet jacks
other mechanical equipment
such assistance is provided at the customer’s request and risk.
Stone & Outdoor will take reasonable care during unloading but accepts no responsibility for damage caused by site conditions outside our control, including but not limited to:
underground services
irrigation systems
drainage pipes
electrical conduits
paved surfaces
driveways
landscaping
soft ground conditions.
Customers must ensure that delivery areas are safe and suitable for unloading equipment.
9. Risk and Title
Risk in the goods passes to the customer:
upon collection, or
upon delivery to the delivery location.
Ownership of goods remains with Stone & Outdoor Pty Ltd until payment has been received in full.
Stone & Outdoor reserves the right to recover goods that have not been paid for.
10. Inspection and Claims
Customers must inspect goods immediately upon delivery or collection.
Any claims relating to:
damage
shortages
incorrect goods
must be reported within 14 days of delivery and before goods are relocated or installed.
Claims will not be accepted where goods have been installed or moved from the delivery location.
Stone & Outdoor’s liability is limited to replacement or refund of the affected product only.
11. Industry Tolerances
Natural stone and similar materials may contain minor defects or breakages.
In accordance with industry standards:
Up to 5% variation, damage, or breakage is considered acceptable.
Customers should retain these pieces for cutting or wastage.
12. Returns
Returns may be accepted for stock items only, subject to approval.
Return conditions include:
request within 14 days of delivery
product must be unused
product must be in original packaging
product must be in saleable condition
Approved returns are subject to:
20% restocking fee plus freight costs
Freight for returned goods is the responsibility of the customer.
Custom, special-order, clearance, or non-stock items cannot be returned.
13. Natural Stone Variations
Natural stone products vary in:
colour
pattern
texture
size
surface finish.
These variations are natural characteristics and not defects.
Stone from different batches may vary in tone or colour.
Customers should blend material from multiple pallets during installation to distribute colour variation.
No claims relating to colour variation will be accepted after installation.
14. Installation Advice
Stone & Outdoor may provide installation guidance or product advice.
Such advice is provided in good faith as general guidance only.
Customers should seek advice from qualified installers or industry professionals.
Stone & Outdoor accepts no responsibility for installation outcomes.
15. Limitation of Liability
To the maximum extent permitted by law:
Stone & Outdoor’s liability is limited to the purchase price of the goods supplied.
Stone & Outdoor will not be liable for:
project delays
installation costs
contractor costs
loss of profit
loss of business
indirect or consequential losses.
Nothing in these Terms excludes rights under the Australian Consumer Law.
16. Project Scheduling Disclaimer
Customers should not schedule installers, contractors, or project works until all materials have been delivered and inspected.
Stone & Outdoor is not responsible for any costs or losses arising from scheduling installation before goods are received.
17. Freight Damage Claims Procedure
Customers must inspect goods immediately upon delivery.
If damage or shortages are identified the customer must:
Note the damage on the freight delivery documentation
Notify Stone & Outdoor within 48 hours
Provide photographic evidence
Failure to follow this procedure may prevent a freight claim from being lodged.
Stone & Outdoor reserves the right to inspect goods before approving any claim.
18. Batch Variation
Products may vary between production batches in:
colour
shade
texture
veining
sizing.
Stone & Outdoor will endeavour to supply products from the same batch where possible but cannot guarantee batch consistency.
Customers should order sufficient material for their entire project in one order where consistency is important.
Batch variation is not considered a defect.
19. Import and Supplier Delays
Many products supplied by Stone & Outdoor are imported.
Delivery may be affected by circumstances beyond our control including:
manufacturing delays
shipping delays
port congestion
customs clearance
transport disruptions.
Stone & Outdoor will endeavour to provide updates but is not liable for delays caused by suppliers or shipping providers.
Custom or imported orders may not be cancelled due to such delays.
20. PPSR Security Interest
Until payment in full has been received, all goods remain the property of Stone & Outdoor Pty Ltd.
The customer acknowledges that these Terms create a security interest under the Personal Property Securities Act 2009 (Cth).
Stone & Outdoor may register this interest on the Personal Property Securities Register (PPSR).
The customer agrees to do all things necessary to allow Stone & Outdoor to register and maintain its security interest.
If the customer defaults on payment, Stone & Outdoor may exercise its rights under the PPSA including recovering goods.
21. Website Orders
Customers placing orders through the Stone & Outdoor website agree to these Terms and Conditions.
Stone & Outdoor reserves the right to:
correct pricing errors
cancel orders where pricing errors occur
refuse orders where necessary.
22. Governing Law
These Terms and Conditions are governed by the laws of Queensland, Australia.
Any disputes arising from these Terms will be subject to the jurisdiction of the courts of Queensland.
